Board of Adjustments and Appeals

The Sussex County Board of Adjustments and Appeals serves as a five-member panel to hear appeals regarding decisions of the Building Official. The Board of Adjustments and Appeals is appointed by the Sussex County Council, and its members serve four-year terms. The board meets as necessary.

Whenever the Building Official shall reject or refuse to approve the mode or manner of construction or when any of the regulations may have been misconstrued or wrongly interpreted, the owner of such project or structure or their duly authorized agent may appeal from the decision of the Building Official to the Board of Adjustments and Appeals. Notice of appeal shall be in writing and filed within 90 days after the decision is rendered by the Building Official. A fee of $600.00 shall accompany such notice of appeal.
